Digital Wallet Pass Terms

These terms apply when you obtain, install or use a digital wallet pass powered by ADVCY (“Pass”).

A Pass may be provided on behalf of an event organiser, artist, brand, community or other organisation (“Issuer”). ADVCY Ltd provides technology used to create and operate the Pass.

1. The Pass

A Pass may provide:

  • event information;
  • membership information;
  • access credentials;
  • ticket or entitlement information;
  • schedules;
  • updates;
  • links;
  • offers where permitted;
  • QR codes or barcodes;
  • verification functionality; or
  • other information relating to the Issuer.

The exact function of a Pass is determined by the Issuer.

2. The Pass is not necessarily your ticket

Unless the Pass expressly says otherwise, adding a Pass to your Wallet does not itself:

  • purchase a ticket;
  • guarantee admission;
  • create a booking;
  • create a payment account; or
  • replace separate terms applying to an event, ticket, membership or purchase.

The Issuer’s event, ticketing, membership or other applicable terms may also apply.

3. Apple Wallet and Google Wallet

The Pass may be made available through Apple Wallet or Google Wallet. Apple and Google operate their Wallet services independently of ADVCY. Your use of those services is also subject to the applicable terms and privacy policies of Apple or Google.

ADVCY does not control:

  • your device;
  • your operating system;
  • Apple Wallet;
  • Google Wallet;
  • internet or mobile connectivity;
  • device-level notification settings; or
  • location permissions controlled by your device.

4. Pass updates

A Pass can be updated after it has been installed. Updates may include changes to:

  • times;
  • venues;
  • rooms or stages;
  • access information;
  • event information;
  • entitlements;
  • pass status; or
  • other information shown on the Pass.

Delivery of an update is not guaranteed. A device may be:

  • switched off;
  • offline;
  • unable to connect;
  • configured to suppress notifications;
  • running unsupported software; or
  • otherwise unable to receive an update.

You should check important event or access information through the Issuer’s official channels where appropriate.

5. Apple Wallet notifications

Apple Wallet may display a change notification when important information contained in a Pass changes.

ADVCY does not use Apple Wallet change messages for advertising, promotional marketing or other non-critical communications.

6. Google Wallet notifications

Google Wallet may support pass-related messages, updates and notifications. Whether a notification appears depends on Google’s functionality and your device settings.

Where an Issuer uses Google Wallet to send direct marketing, appropriate marketing permissions must be in place where required.

7. Location relevance

A Pass may contain the coordinates of a venue or other relevant location. Apple Wallet or Google Wallet may use the location of your device to make the Pass available or more prominent when you are nearby.

Adding coordinates to a Pass does not, by itself, mean that ADVCY or the Issuer receives your precise device location.

Where an ADVCY service separately collects or receives your precise location, you will be provided with additional information and any permission required by law will be requested.

8. Marketing

Installing a Pass does not automatically mean that you agree to receive unrelated direct marketing. Where marketing consent is required, it will be requested separately.

You can withdraw consent or object to direct marketing at any time using the method given when you signed up or by contacting the relevant Issuer. Where ADVCY is responsible for the marketing you can contact community@advcy.ai.

9. Pass verification

A Pass may contain a unique token, barcode, QR code or other identifier. When the Pass is presented for scanning or verification, information required to determine whether the Pass is valid may be shared with the Issuer and authorised access or verification providers.

This can include:

  • Pass identifier;
  • validity;
  • entitlement;
  • redemption status;
  • event;
  • location or checkpoint; and
  • time of verification.

Where possible, unnecessary contact or profile information will not be exposed to scanners.

10. Protect your Pass

You are responsible for taking reasonable care of your device and Pass. Do not intentionally:

  • duplicate a Pass where duplication is prohibited;
  • alter a Pass;
  • forge or manipulate a Pass;
  • provide an access credential to someone who is not entitled to use it; or
  • attempt to bypass access or verification controls.

11. Lost or stolen devices

If your device is lost, stolen or compromised, contact the Issuer if the Pass provides access, entitlement or value that may need to be revoked or replaced. Where supported, a Pass may be revoked or reissued.

ADVCY cannot guarantee that unauthorised use will be prevented before the relevant Pass is revoked or disabled.

Nothing in these terms excludes responsibility where loss was caused by ADVCY’s breach of applicable law or by liability that cannot legally be excluded.

12. Availability

We use reasonable care in providing ADVCY technology, but Wallet functionality depends on systems outside our control. We cannot guarantee:

  • uninterrupted availability;
  • delivery of every notification;
  • real-time updating;
  • uninterrupted third-party Wallet services; or
  • compatibility with every device.

An already-installed Pass may remain visible while a device is offline, but live updating, verification or other connected functionality may require internet access.

13. Intellectual property

The ADVCY technology used to provide the Pass belongs to ADVCY or its licensors. Logos, artwork, event names, photographs, trademarks and other Issuer content belong to the Issuer or their respective owners.

You may use the Pass for its intended personal purpose. You must not copy, modify, reverse engineer, resell or commercially exploit ADVCY technology except where the law expressly permits it.

14. Privacy

How personal information is handled is explained in the ADVCY Privacy Policy.

The Issuer’s own privacy notice may also apply.

The wallet download page should identify the relevant Issuer and provide access to its privacy information where required.

15. Removing the Pass

You can remove a Pass using Apple Wallet or Google Wallet controls. Removing the Pass may stop future Pass updates but does not necessarily delete information held separately by the Issuer or ADVCY.

16. Changes or withdrawal

An Issuer may need to change, expire, revoke or withdraw a Pass where reasonably necessary, for example because:

  • an event has finished;
  • an entitlement has expired;
  • a Pass was issued in error;
  • misuse is suspected;
  • an event has changed; or
  • legal or security requirements apply.

Where appropriate, reasonable notice will be provided.

17. Your statutory rights

Nothing in these terms affects rights that you have under applicable consumer or data-protection law.

Nothing in these terms excludes or limits liability where doing so would be unlawful.

18. Governing law

These terms are governed by the laws of England and Wales.

If you are a consumer, you may also have mandatory rights under the law of the country in which you live and nothing in these terms removes those rights.
